PDRM Summon: Talking On The Phone While Driving

A story from a friend...

My friend was on his way back from his hometown to his PJ house...

He was charging his mobile phone with the car charger and he placed the phone on a tray.

He received a call just before he paid for his toll fare near The Curve.

He answered the call. 

He was talking on the phone with his left hand holding the mobile phone to his left ear.

He did not manage to put his earphone onto his phone because he would have to find for it and he might use both hands to do so.

If that's the case, both of his hands would not be on the steering wheel and it would be more dangerous.

He was talking on the phone while driving with his right hand until he drove up the flyover in front of One Utama.

He noticed that he was following a police car at some distance on the fast lane.

Then, he drove to the middle lane and at the same time he told the caller that there was a police car.

He quickly put the phone on his lap and then put back on the tray.

He looked in front and held the steering wheel with both of his hands tried to pretend that he was driving like anyone else on the road.

When my friend's car was side by side/aligned with the police car, my friend saw the police at the passenger seat used his hand to signal my friend to stop the car by the side of the road.

My friend thought, "Ow man, I should have driven faster and pretended I did not see his signal. They might pursue me though..."

He signaled to the left and stopped his car by the road.

A policeman walked to his car and asked him to show his license and Identity Card.

He gave them to the policeman.

The policeman started by asking him, "Encik, mengaku tak tadi memandu sambil mendengar telefon? (Sir, do you admit that you are using the mobile phone while you are driving?"

He answered, "Tak ada. Tadi saya cuma mengambil telefon bimbit saya dan menyemak sama ada telefon saya telah selesai dicas. (No. I just pick up my phone to check whether it has finished charging or not.)"

The policeman said, "Ooh, encik semak sampai letak di telinga ke? (I see. You check until you put on your ear?)"

He said, "Tak ada. Cuma semak sudah selesai dicas ke belum sahaja. (No. Just check to see whether it's finished charging or not.)"

The policeman said, "Ok. Kalau macan itu, saya bagi saman saja la. Nanti encik boleh pergi bayar saman ini di mahkamah di Jalan Duta. Encik kena bayar RM350 untuk saman ini. Kalau encik rasa encik tak bersalah dan tak mahu bayar saman ini, encik boleh pergi ke mahkamah dan membela diri sendiri.
(Okay. If that's the case, I will just give you a summon. Later you can go to the court at Jalan Duta to pay the summon. It will cost you MYR350. If you think you are innocent and do not want to pay for the summon, you can go to the court and plead not guilty.)"

He said, "Ok. Kalau macam itu, bagi saya saman la. Mesti pergi ke mahkamah di Jalan Duta untuk membayar saman ini ke? Ada tak tempat lain yang boleh bayar? (All right. Just give me the summon. Is it a must to go to the court at Jalan Duta to pay for the summon? Is there any other places that I can go to pay for it?)"

The policeman said, "Encik boleh pergi ke pejabat pos juga. Jadi, encik mahu saman ini la? Saya tak bagi kompaun. Macam mana? (You can go to the pos office also. So, you want this summon? I do not give compound. So how?)"

He asked, "Apa itu kompaun? (What is compound?)"

The policeman said, "Kompaun itu macam diskaun bagi saman. (Compound is a discount for summon.)"

He said, "Ooh, Ya ke? (Ooh. Is it?)"

The policeman said, "Macam mana? Saya bagi saman ke? (So how? I give you a summon?)"

He said, "Erm...Saya boleh macam mana. Tadi encik pun kata mesti bagi saman dah. Saya boleh buat apa lagi? (Hmm...What can I do? Just now you say you must issue a summon already. What else can I do?)"

The policeman said, "Kita boleh settle di sini... Saya okay je. Saya tak kasih la. Saya pun orang dari Pahang. (We can settle it here... I am fine with it. I don't mind. I am from Pahang as well.)"

He said, "Ooh, ya ke? Mana tu? Macam mana tu? Erm... Kalau saya nak settle di sini, berapa tu? Saya lupa pergi ambil wang dari bank tadi. Saya tak adalah bawa banyak sangat wang dengan saya sekarang. Paling banyak pun RM50 sahaja. (How? Hmm...If I want to settle it here, how much is that? I forgot to withdraw money from the bank just now. I do not have a lot of money with me now. The most is MYR50 only.)"

The policeman said, "Saya dari Mentakab. Boleh la... (It's fine.)"

He said, "Ok. (All right)" [Under the dim lighting, I forked out MYR1...MYR1...MYR1 (purposely)...then finally a note of MYR50 and put it on the summon book...]


He asked, "Jadi, encik tak ada tulis apa-apa kan? (So, do you write anything?)"

The policeman said, "Tak ada... (No...)" 

The policeman walked back to his police car, which was parked behind my friend's car.

My friend closed the car door and drove away.
